Terms of Service

1. Acceptance of Terms

By accessing or using StartupPulse ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not access the Platform. These Terms are governed by and construed in accordance with the laws of the Republic of India, including the Information Technology Act, 2000 and the Indian Contract Act, 1872.

2. Eligibility

  • You must be at least 18 years of age to use the Platform
  • You must provide accurate and complete registration information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You agree to accept responsibility for all activities that occur under your account

3. Description of Services

StartupPulse provides:

  • Real-time startup funding news aggregation and AI-powered signal scoring
  • Verified founder directory and networking tools
  • Community discussion channels and private messaging
  • Company intelligence and market analysis tools
  • Founder-authored insights and knowledge sharing

4. User Conduct

When using the Platform, you agree NOT to:

  • Post content that is defamatory, obscene, abusive, or violates any Indian law
  • Impersonate any person or entity, or misrepresent your affiliation
  • Use the Platform for any unlawful purpose or to solicit illegal activities
  • Attempt to gain unauthorized access to any part of the Platform
  • Scrape, data-mine, or use automated tools to extract data from the Platform
  • Transmit spam, chain letters, or unsolicited commercial messages
  • Upload malicious code, viruses, or any harmful content

Violation of these guidelines may result in immediate account suspension or termination, and may be reported to relevant Indian law enforcement authorities under the IT Act, 2000.

5. Intellectual Property

All content on the Platform — including but not limited to text, graphics, logos, icons, images, software, and the AI Signal Score algorithm — is the property of StartupPulse or its content suppliers and is protected by Indian copyright law and international treaties.

Content posted by users in community channels or insights remains the intellectual property of the respective users, but by posting, you grant StartupPulse a non-exclusive, worldwide, royalty-free license to display, distribute, and reproduce such content on the Platform.

6. Founder Verification

The "Verified Founder" badge indicates that a user has completed our email verification process. It does NOT constitute an endorsement of the founder, their company, or any claims made. StartupPulse is not responsible for verifying the accuracy of information provided by founders.

7. Third-Party Data and Links

The Platform aggregates news from third-party sources (NewsAPI, The Guardian, GNews, Hacker News). StartupPulse does not guarantee the accuracy, completeness, or timeliness of third-party data. Any links to external websites are provided for convenience only and do not imply endorsement.

8. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. STARTUPPULSE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. THE AI SIGNAL SCORES ARE ALGORITHMIC ASSESSMENTS AND SHOULD NOT BE RELIED UPON AS FINANCIAL OR INVESTMENT ADVICE.

9. Limitation of Liability

To the maximum extent permitted under Indian law, StartupPulse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill, arising from your use of the Platform.

10. Indemnification

You agree to indemnify and hold harmless StartupPulse, its founders, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

11. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Platform ceases immediately.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in New Delhi, India. Before initiating legal proceedings, the parties agree to attempt resolution through mediation.

13. IT Act 2000 Compliance

In accordance with the Information Technology Act, 2000 (as amended) and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021:

  • We act as an intermediary under Section 2(1)(w) of the IT Act
  • We provide a mechanism for users to report objectionable content
  • We will remove unlawful content within 36 hours of receiving a valid complaint
  • We retain user information as required under applicable Indian law

14. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.
